I understand that this accident waiver and release of liability (AWRL) will be used by RBO, its officers, directors, race directors, coaches, volunteers, agents, EBBR, East Bay Regional Park District, the City of Oakland, all event sponsors and donors, and all other person(s) associated with the event, their representatives and successors. Comprehension and Assumption of Risk: I know that running a road race is potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform this event, and am in good health, and I am properly trained. I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the race and agree to abide by them. I assume all risks associated with running in this event, including but not limited to: falls, contact with other participants, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the running path at Martin Luther King Jr. Regional Shoreline, all such risks being known and appreciated by me. I understand that bicycles, skateboards, baby joggers, roller skates or roller blades, animals, and personal music players are not allowed in the race and I will abide by all race rules. Medical Expenses and Consent to Medical Treatment: I accept full financial responsibility for any personal medical expenses or treatment which may result from participation in the event, and hereby release RBO, and all parties referred to in this waiver, in full from any potential claim for such medical expenses. I authorize RBO to provide medical treatment which may be deemed advisable, whether resulting from an emergency or otherwise, and release RBO, and said parties, from any and all actions in tort for the provision of such medical attention. Nothing in this paragraph shall be construed to create an actual or implied duty upon RBO to provide or seek such medical attention for me. No Refunds: I understand that this event does not provide for refunds in the event of a cancellation, and by signing this waiver, I consent that I am not entitled to a refund if the event is cancelled before or during the event. Consumption of Alcohol: I understand that the consumption of alcohol will be at my own discretion, risk and liability. If I choose to consume alcoholic beverages during the event, I attest I am twenty-one (21) years of age or older, and will be required to produce government-issued photo identification prior to the commencement of the event. I affirm it is my responsibility to ensure I consume alcohol in a responsible manner, and that RBO reserves the right to excuse any participant from the event if said participant becomes inebriated or misbehaves or has the potential to cause harm to him or herself or any other person. If I am excused from the event pursuant to this paragraph, it shall be without any reimbursement by RBO. I assume all risks involved with the consumption of alcohol, including traveling to and from the event, and unconditionally hold RBO, and all parties referred to in this waiver, harmless. Use of Likeness: I grant permission to all of the foregoing to use my photographs, motion pictures, recordings or any other record of this event for any legitimate purpose. Having read this waiver and knowing these facts and in consideration of your accepting my entry, I, for myself and anyone entitled to act on my behalf, waive and release, and agree to indemnify and hold harmless, Running for a Better Oakland (RBO), its officers, directors, race directors, coaches, volunteers, agents, East Bay Beer Runners (EBBR), East Bay Regional Park District, the City of Oakland, all event sponsors and donors, and all other person(s) associated with the event, their representatives and successors, from all claims or liabilities of any kind arising out of my participation in this event, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. This AWRL will be interpreted broadly to provide a release and waiver to the maximum extent permissible under the law. If the applicant is under the age of 18 years of age, the parent or guardian must execute this AWRL on the applicant’s behalf.
